The independent Policing Oversight Authority (IPOA) needs more time to tighten the case against the police officer involved in a shooting drama at a Nakuru night club that left two people dead.

While seeking more time to conclude investigations, IPOA through state Prosecutor Wyclif Omwenga said the investigations that were carried out by the Directorate contained some gaps that needed to be filled.

Mr Omwenga informed the court that IPOA needed to forward three more guns that were used during the night of December 13, 2023 to the forensic examination in Nairobi before charging the suspect identified as Mr Nicholus Musau Musyoka.

Mr Musau, a police officer attached at the Nakuru central Police station is being investigated for murder charges, following the death of two people he allegedly shot in an entertainment joint.

He is alleged to have shot four people killing one on the spot after a disagreement ensued over a Sh 13,000 bill.

IPOA took up the matter on December 21 following a directive by the Directorate of Public prosecution which they successfully applied for 21 days to conclude investigations.

Appearing before Senior Resident magistrate Linah Akoth, Mr Omwenga said IPOA has already obtained the three firearms which it needs 14 more days to obtain ballistic report.

“IPOA took over the matter on December 21 from the Directorate of Criminal investigations and upon perusing the police file, they discovered there were missing links in the investigations. Some firearms were missing, despite there being spent cartridges from more than one firearm,” said Mr Omwenga.

The defence lawyer David Mong’eri however protested the application which was only being done orally to the violation of his client’s freedom.

Mr Mong’eri claimed the continued detention is a violation of his client’s rights against pre-trial detention.

The magistrate will deliver her ruling Today.
