The Nakuru Law court has today given an order in favour of Nakuru War Memorial Hospital, noting that the hospital staff should be allowed entry at the hospital to allow normal hospital operations to resume.

This follows a report submission, by the Deputy registrar at the Nakuru Law courts, Ms. Priscah Nyotah, who visited the hospital to make her observation if indeed the county had forcibly taken over the hospital and evicted the hospital’s staff, bringing the hospital's operations to a standstill.

Other than that, legal counsel representing the hospital had moved to court to sue the county over contempt of court, following the illegal takeover of the facility.

In her ruling, Environment and Land Court Justice Millicent Odeny, directed the Nakuru County Police Commander, Samuel Ndanyi, to give the hospital management support in order to reinstate normal operations at the facility with no interference by the county government.

She further stated that the County had disobeyed court orders issued on October 30, 2023, which barred them from interfering with operations at the hospital.

The takeover which happened in the wee hours of Tuesday morning aroused panic for patients and staff at the facility.

More to it, patients at the facility were left unattended during the chaotic takeover and by 6am all staff had vacated the hospital’s premises.

The Rift Valley Law Society of Kenya (LSK) President, Aston Muchela said he witnessed the height of impunity today, after the police tried restricting the entry of the deputy registrar who has been deputized by the high court judge to ascertain what is happening at the hospital.

Further noting in regards to the turn of events at the hospital, LSK will be collecting evidence of human rights violations and will file a petition against individuals involved and have victims of such violations compensated in the event their rights were infringed.

“It is sad to see patients begging for services they have paid for. The right to health care is a constitutional right and should be enjoyed by everyone without any violations,” says Muchela.
